Divorce Questions? Call 801-676-5506 - Question: Are Divorce Laws Against Men?

I was asked this week, why are the divorce laws against men?

 Under Utah law, there is a presumption of equality for me and women under the law.

 In fact, under Utah law, there is a presumption that parents share joint legal custody of their minor children.

 

There shouldn't be any divorce law against men or women.

 I can tell you that specific facts play a role in each case.

 What I mean by that is, if you have a drug addiction, that will hurt you in court, whether you are a man or a woman.

 If you beat your spouse or have injured or hurt your kids (think child abuse) - then that will hurt your divorce case.

 Facts are important -- the more favorable ones you have on your side, the better you case will be.

 The more negative you have on your case, the worse your case will be.
