Divorce Questions? Call 801-676-5506 - Question: Are Divorce Laws Against Men?
I was asked this week, why are the divorce laws against men?
Under Utah law, there is a presumption of equality for me and women under the law.
In fact, under Utah law, there is a presumption that parents share joint legal custody of their minor children.
There shouldn't be any divorce law against men or women.
I can tell you that specific facts play a role in each case.
What I mean by that is, if you have a drug addiction, that will hurt you in court, whether you are a man or a woman.
If you beat your spouse or have injured or hurt your kids (think child abuse) - then that will hurt your divorce case.
Facts are important -- the more favorable ones you have on your side, the better you case will be.
The more negative you have on your case, the worse your case will be.

If The Parent Who Has Custody Was Not Spending Enough Time With The Child, Would The Other Parent Be Able To File For A Review Of The Custody?
They would definitely need to contact an attorney at that point. Based on the history and what they had done in the past, it would be advisable for them to file a petition if they wanted to move forward so they could enforce their rights.
Anytime you need to change custody, there has to be a reason for the change.
In your life, in your specific circumstances, ask yourself what has changed: Has someone moved? Has someone obtained a new job? Has a child changed schools? Has a child been bullied at school and needs a change?
Whatever the change is, you should contact an attorney to discuss the change.
